DOMA Struck Down – Thank you 2017-10-30T15:53:34+04:00 Kimberly Knight

Some phrases that took my breath away in the UNITED STATES v. WINDSOR, EXECUTOR OF THE

ESTATE OF SPYER, ET AL. case

“DOMA is unconstitutional as a deprivation of the equal liberty of persons that is protected by the Fifth Amendment. “DOMA singles out a class of persons deemed by a State entitled to recognition and protection to enhance their own liberty.”

“There is a “careful consideration” standard: In determining whether a law is motivated by improper animus or purpose, discriminations of an unusual character especially require careful consideration. DOMA cannot survive under these principles.

The federal statute is invalid, for no legitimate purpose overcomes the purpose and effect to disparage and injure those whom the State, by its marriage laws, sought to protect in personhood and dignity. By seeking to displace this protection and treating those persons as living in marriages less respected than others.”

To be clear: Windsor does not establish a constitutional right to same sex marriage but good Lord almighty, this is a great day where we are witness to a new and visible bend in the arc of the universe toward justice.

Thank you Edith and Thea

Thank you to everyone who marched.

Thank you to everyone who prayed.

Thank you to everyone who blogged.

Thank you to everyone who changed your profile picture.

Thank you to everyone who held hands when it was not safe.

Thank you to everyone who placed a same-sex family picture on your desk at work.

Thank you to the legislators who stand for true equality in cities, states and our nation’s capital.

Thank you to everyone who spoke up when a friend, neighbor or family member was confused, afraid or disparaging.

Thank you to everyone who preached of God’s radical hospitality.

Thank you to all who have come before and given your lives to this journey of equality.

Thank you to all who will come after and continue the struggle for “liberty and justice for all” to really mean ALL.

Thank you God.
