For the good of the country, President Biden must arrest Donald Trump immediately.

No longer running for re-election and susceptible to charges of partisanship, Biden must use the authority given to him on July 1, 2024, by the United States Supreme Court.

Biden has the unquestionable and absolute executive authority to have Trump arrested and detained until his Jan. 6 trail is complete.

Presidents have had the authority to suspend habeas corpus for more than 150 years. Since the Donald J. Trump v. United States decision, Biden has absolute immunity to do what he deems necessary to fulfill his Constitutional responsibility to protect the United States, including arresting Trump for election interference.

“We conclude that the separation of powers principles explicated in our precedent necessitate at least a presumptive immunity from criminal prosecution for a President’s acts within the outer perimeter of his official responsibility,” wrote Chief Justice John Roberts. “Such an immunity is required to safeguard the independence and effective functioning of the Executive Branch, and to enable the President to carry out his constitutional duties without undue caution.”

Elsewhere, Roberts writes, “investigation and prosecution of crimes is a quintessentially executive function.” The president has “‘exclusive authority and absolute discretion’ to decide which crimes to investigate and prosecute, including with respect to allegations of election crime.”

When Biden has Trump arrested and held pending trial, according to Roberts, “courts may not inquire into the President’s motives.”

Even after the Trump v. United States decision, Trump remains a convicted felon facing additional federal charges of election interference.

According to Trump v. United States:

“… the indictment alleges that Trump and his co-conspirators attempted to convince those officials that election fraud had tainted the popular vote count in their States, and thus electoral votes for Trump’s opponent needed to be changed to electoral votes for Trump. After Trump failed to convince those officials to alter their state processes, he and his co-conspirators allegedly developed a plan ‘to marshal individuals who would have served as [Trump’s] electors, had he won the popular vote’ in Arizona, Georgia, Michigan, Nevada, New Mexico, Pennsylvania, and Wisconsin, ‘and cause those individuals to make and send to the Vice President and Congress false certifications that they were legitimate electors.’”

Biden must ensure that democracy has its day in court and arrest Trump as a clear and present danger to the country and democracy.

A convicted felon facing additional charges and nearly half a billion dollars in fines, Trump is a desperate and dangerous criminal.

If Biden doesn’t act immediately, Trump will act after he’s elected.

Trump has repeatedly and expressly said that his perceived political enemies must be “locked up,” And he will do so because he will have absolutely no legal safeguards stopping him.

Trump will have the authority to suspend the results of every election he contests, regardless of evidence, pending investigations.

Perhaps he will invoke executive privilege to suspend the Constitution’s Twenty-second Amendment and stay in office while his administration investigates the results of the next presidential election.

He has millions of supporters across the country who deny he lost the last election and who will continue to support his usurpation of power in any form.

His administration was filled with criminals acting as foreign agents for other governments – and Trump pardoned them all. Trump committed crimes both before and while in office.

Donald Trump is an ongoing criminal enterprise, and any investigation Biden initiates “cannot be subject to further judicial examination.” Therefore, Biden must take action immediately.

The Supreme Court has given Biden unlimited authority to take any official actions including investigations of “allegations of election crime.” If Biden doesn’t use this authority, our democracy may be lost forever.
